Welcome to Köenig Outdoors. These Terms of Service (“Terms”) govern your access to and use of koenigoutdoors.com (the “Site”) and your purchase or use of products and services offered by Köenig Outdoors (“Köenig Outdoors,” “we,” “us,” or “our”).

By visiting our Site, purchasing a product, or otherwise using our services (collectively, the “Services”), you agree to be bound by these Terms. If you do not agree with these Terms, you should not access or use the Services.

Our store is hosted by Shopify, which provides the e-commerce platform that allows us to offer and sell our products to you.

1. Eligibility and Use of the Site

By using the Services, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you have the consent of a parent or legal guardian where required.

You agree to use the Site and Services only for lawful purposes and in accordance with these Terms.

You may not use our products, Site, or Services for any illegal or unauthorized purpose or violate any applicable laws in connection with your use of the Services.

You may not transmit viruses, malware, malicious code, or otherwise interfere with the operation or security of the Site.

We reserve the right to refuse service to anyone for any lawful reason at any time.

2. Products and Product Information

We make reasonable efforts to display and describe our products as accurately as possible, including product colors, dimensions, specifications, materials, features, and images.

However, colors and appearance may vary depending on your device or display, and minor differences may occur between product images and the product you receive.

We reserve the right, without obligation, to:

Modify product designs, specifications, materials, or features;
Limit quantities available for purchase;
Discontinue products;
Limit sales to particular persons, geographic regions, or jurisdictions; and
Correct errors or inaccuracies in product descriptions.

All products are subject to availability.

3. Prices and Payment

Prices displayed on the Site are subject to change without notice.

We reserve the right to correct pricing, promotional, or product-information errors, including after an order has been submitted. If an error affects your order, we may contact you with the option to proceed at the corrected price or cancel the affected order.

Applicable taxes, shipping charges, and other fees will be displayed during checkout when required.

By submitting payment information, you represent that you are authorized to use the payment method provided and authorize us and our payment processors to charge the applicable amount.

4. Orders and Order Acceptance

Submitting an order does not guarantee acceptance of the order.

We reserve the right to refuse, limit, or cancel an order for legitimate reasons, including suspected fraud, unauthorized transactions, product availability, incorrect pricing, inventory errors, or suspected resale or abuse of promotions.

If we cancel an order after payment has been processed, we will refund the applicable amount to the original payment method.

You agree to provide current, complete, and accurate billing, shipping, payment, and contact information for your purchases.

5. Shipping and Delivery

Shipping and delivery estimates are provided as estimates only and are not guaranteed unless expressly stated otherwise.

Once an order is transferred to a shipping carrier, delivery times may be affected by circumstances outside our reasonable control, including carrier delays, weather, natural disasters, customs processing, transportation disruptions, or incorrect delivery information.

Customers are responsible for providing an accurate and complete shipping address.

If you believe an order has been lost, damaged, or incorrectly delivered, please contact us so we can assist you.

6. Returns and 60-Day Sleep Guarantee

Certain Köenig Outdoors products are eligible for our 60-Day Sleep Guarantee.

If an eligible sleeping pad does not meet your needs, you may request a return within 60 days of delivery for a refund of the purchase price, subject to the requirements and exclusions contained in our Returns, Refunds & Warranty Policy.

Among other requirements:

The return request must be submitted within 60 days of delivery;
The product may be used but must be returned in reasonably clean condition;
Products showing intentional damage, misuse, modification, or abuse may not qualify;
Customers are responsible for return shipping costs for returns under the 60-Day Sleep Guarantee; and
Original shipping charges, if any, are non-refundable.

Refunds are issued to the original payment method after the returned product has been received and inspected.

Our current Returns, Refunds & Warranty Policy is incorporated into these Terms by reference. If there is a conflict regarding a return, refund, or warranty claim, the Returns, Refunds & Warranty Policy will control with respect to that claim.

7. Two-Year Limited Warranty

Köenig Outdoors products are covered by a 2-Year Limited Warranty against defects in materials and workmanship from the date of purchase, subject to the terms and exclusions in our Returns, Refunds & Warranty Policy.

The warranty applies to manufacturing defects occurring during normal and intended use.

The warranty does not cover damage resulting from circumstances including:

Accidents;
Punctures, cuts, tears, or abrasions caused by use;
Misuse or neglect;
Improper care;
Unauthorized modifications;
Normal wear and tear;
Cosmetic wear that does not affect product performance; or
Exposure to excessive heat, chemicals, or abnormal conditions.

For an approved warranty claim, Köenig Outdoors may, at its discretion, repair the product, replace it with the same or a comparable product, or issue a refund if an appropriate replacement is unavailable.

8. Outdoor Activity and Assumption of Risk

Köenig Outdoors products are designed for outdoor and recreational use. Outdoor activities, including camping, hiking, hunting, backpacking, and related activities, involve inherent risks.

Conditions in outdoor environments can be unpredictable and may include severe weather, extreme temperatures, difficult terrain, wildlife, equipment failure, accidents, and other hazards.

You are responsible for determining whether a product is appropriate for your intended activity and conditions and for using the product according to its intended purpose and any provided instructions.

No outdoor product should be relied upon as a substitute for appropriate preparation, judgment, experience, emergency equipment, or safety precautions.

To the fullest extent permitted by applicable law, Köenig Outdoors is not responsible for injuries, losses, or damages resulting from misuse of a product, failure to follow instructions, modification of a product, use outside its intended purpose, or risks inherent in outdoor activities.

9. Product Care and Proper Use

Customers are responsible for properly using, storing, cleaning, maintaining, and inspecting products.

You should inspect outdoor equipment before use and discontinue use if a product shows damage or deterioration that could make continued use unsafe or inappropriate.

Modification, misuse, improper storage, or improper maintenance may reduce product performance and may affect warranty eligibility.

10. Intellectual Property

Unless otherwise stated, all content available through the Site, including text, product names, product designs, photographs, graphics, logos, videos, illustrations, icons, website designs, and other materials, is owned by or licensed to Köenig Outdoors and is protected by applicable intellectual-property laws.

You may access and use the Site for your personal, non-commercial use.

You may not reproduce, distribute, modify, publish, sell, license, create derivative works from, or commercially exploit our Site content without our prior written permission.

Nothing in these Terms grants you ownership of any Köenig Outdoors intellectual property.

11. Reviews, Feedback, Photos, and User Content

If you submit reviews, photographs, comments, suggestions, testimonials, ideas, or other content to us (“User Content”), you represent that you have the right to provide that content.

You grant Köenig Outdoors a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, adapt, and publish User Content in connection with operating, promoting, and marketing our business and products, subject to applicable law.

You may not submit content that is unlawful, threatening, defamatory, obscene, fraudulent, infringing, malicious, or that violates another person’s rights.

We reserve the right to remove User Content that violates these Terms or applicable law.

12. Third-Party Services and Links

The Services may contain links to or integrations with third-party websites, applications, payment processors, shipping providers, social-media platforms, or other services.

We do not control and are not responsible for the content, policies, availability, security, or practices of third-party services.

Your use of third-party services may be governed by separate terms and privacy policies provided by those third parties.

13. Shopify

Our online store is hosted by Shopify.

Your information may be processed by Shopify and other service providers as necessary to operate the store, process transactions, prevent fraud, and provide the Services.

14. Privacy

Your submission of personal information through the Site is governed by our Privacy Policy.

Please review our Privacy Policy for information about how Köenig Outdoors and its service providers collect, use, process, and disclose personal information.

15. Prohibited Uses

In addition to other restrictions described in these Terms, you may not use the Site or Services:

For unlawful purposes;
To solicit others to participate in unlawful activities;
To violate applicable laws or regulations;
To infringe our intellectual-property rights or the rights of others;
To harass, threaten, abuse, discriminate against, or harm others;
To submit false or misleading information;
To transmit malicious software or code;
To collect or track another person’s personal information unlawfully;
To spam, phish, scrape, crawl, or interfere with the operation of the Site;
To circumvent security features of the Site; or
To engage in fraudulent transactions or abuse our return, warranty, promotional, or purchasing programs.

We may suspend or terminate access to the Services for violations of these restrictions.

16. Disclaimer of Warranties

Except for warranties expressly provided by Köenig Outdoors, including our applicable written limited warranty, and except where prohibited by law, the Site and Services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by applicable law, we disclaim implied warranties, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

Some jurisdictions do not allow limitations or exclusions of certain warranties, so some of these limitations may not apply to you.

Nothing in these Terms is intended to eliminate consumer rights that cannot legally be waived.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Köenig Outdoors and its owners, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from your use of the Site, Services, or products.

This includes, where permitted by law, loss of profits, revenue, savings, data, opportunities, or other intangible losses.

To the fullest extent permitted by law, Köenig Outdoors’ aggregate liability arising from a product purchase will not exceed the amount you paid to Köenig Outdoors for the product giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Köenig Outdoors and its owners, officers, employees, affiliates, agents, contractors, licensors, and service providers from third-party claims, damages, liabilities, and reasonable expenses arising from your violation of these Terms, misuse of the Services, or violation of another person’s rights.

19. Errors and Inaccuracies

Occasionally, information on the Site may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability.

We reserve the right to correct errors or omissions and update information at any time without prior notice, subject to applicable law.

20. Promotions and Discount Codes

Promotions, giveaways, discounts, and promotional codes may be subject to additional terms.

Unless otherwise stated, promotional offers:

Cannot be combined with other offers;
Have no cash value;
May be limited to one use per customer or household;
May exclude certain products; and
May be modified or discontinued where permitted by law.

We reserve the right to reject or cancel orders involving fraudulent or unauthorized use of promotions.

21. Governing Law

These Terms and your use of the Services will be governed by the laws applicable in the State of Utah, United States, without regard to conflict-of-law principles, except where applicable consumer-protection laws require otherwise.

Nothing in this section limits any rights you may have under mandatory consumer-protection laws in your jurisdiction.

22. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

23. No Waiver

Our failure to exercise or enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

24. Entire Agreement

These Terms, together with our Privacy Policy, Returns, Refunds & Warranty Policy, and any other policies or operating rules posted on the Site, constitute the agreement between you and Köenig Outdoors regarding your use of the Services.

25. Changes to These Terms

We may update these Terms periodically to reflect changes to our products, Services, business practices, or applicable legal requirements.

When changes are made, we will post the revised Terms on this page and update the “Last Updated” date.

Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
